1. Introduction
These Terms of Use (“Terms”) govern the use of Red Camel Commerce Tool (“RC Tool” or “Software”), a WordPress-based commerce software product developed and published by The Hafiz Agency (“Agency”, “we”, “us” or “our”).
By downloading, installing or using RC Tool, you acknowledge these Terms, subject to the rights granted to you under the applicable GNU General Public License (GPL).
These Terms apply specifically to RC Tool. They do not constitute general terms and conditions for the Agency’s website or every other service offered by the Agency.
2. Software ownership
RC Tool is developed, owned and published by The Hafiz Agency, operated by Hafiz Mahmud.
The Agency retains ownership of its original intellectual property in the Software, subject to the rights granted under the applicable GPL and any applicable third-party licences.
The Agency may maintain, update, distribute, license, assign or transfer its ownership interests in the Software, subject to the applicable licence terms and law.
The Agency’s private internal systems, credentials, branding, website and separately operated services are not automatically included in the Software distribution.
3. Open-source licence
RC Tool is distributed under the GNU General Public License.
The exact GPL version applicable to a particular release is identified in that release’s accompanying LICENSE file.
The GPL governs the rights and obligations associated with using, copying, modifying and distributing the Software.
Nothing in these Terms is intended to:
- Restrict rights granted under the GPL.
- Prevent users from running the Software for purposes permitted by the GPL.
- Prevent users from studying or modifying the Software.
- Prevent lawful redistribution of the Software or modified versions under the GPL.
- Impose additional restrictions that conflict with the applicable GPL.
Users who redistribute the Software or derivative works must comply with the applicable GPL requirements.
Third-party components may be subject to separate copyright notices and licence terms.
4. Installation and operation
RC Tool is designed to operate on WordPress websites.
Users are responsible for:
- Their domain name, hosting and WordPress installation.
- Their website’s general administration and security.
- Configuring the Software appropriately.
- Maintaining backups of their websites and business information.
- Keeping relevant software and dependencies updated.
- Testing configurations before accepting real customer orders.
- Ensuring that their use of the Software complies with applicable laws.
The Agency does not automatically host or operate a Merchant’s website simply because RC Tool is installed on it.
5. Merchant responsibilities
A person or business using RC Tool (“Merchant”) remains responsible for its own commercial activities.
This includes:
- Products and services offered.
- Product descriptions, images and representations.
- Pricing and availability.
- Advertising and promotional claims.
- Customer communication and support.
- Order fulfilment and delivery.
- Refunds, cancellations and returns.
- Applicable taxes and business obligations.
- Compliance with consumer-protection, privacy and other applicable laws.
The Merchant is responsible for the information it publishes and the transactions it accepts through its website.
The Agency does not become a party to a Merchant’s sales contract with its customers merely because the Merchant uses RC Tool.
6. Customer and order information
RC Tool is designed to allow Merchants to manage commerce activities through their own WordPress installations.
Unless a separately configured service or integration provides otherwise, product, order and customer information is managed within the Merchant’s own website and hosting environment.
The Merchant is responsible for protecting this information and providing its customers with appropriate privacy notices and other legally required information.
The Agency does not automatically own or control a Merchant’s customer database.
7. Payment integrations
RC Tool may support integrations with third-party payment providers.
The Merchant is responsible for:
- Opening and maintaining any required payment-provider account.
- Meeting the provider’s verification and eligibility requirements.
- Obtaining and configuring its own API credentials.
- Keeping secret credentials secure.
- Complying with the provider’s terms and technical requirements.
- Confirming that payments have actually succeeded before fulfilling orders.
Payment processing, settlement, fees, reversals, refunds, chargebacks and payment availability are governed by the applicable payment provider’s terms and arrangements.
The Agency does not guarantee that a particular payment provider will approve a Merchant or continue providing its services.
The Agency’s own private platform credentials are not included in the public RC Tool distribution.
8. Third-party software and services
RC Tool may interact with WordPress, hosting providers, payment providers, APIs, themes, plugins and other third-party services.
Those services are operated independently and may have their own terms, privacy policies, availability conditions and technical requirements.
The Agency is not responsible for independent changes, interruptions, pricing decisions or failures of third-party services.
Merchants should review the terms of any third-party service they choose to integrate.
9. Updates and support
The Agency may publish updates, improvements, security fixes and new versions of RC Tool.
The Agency may also provide documentation or support through its website or other communication channels.
Unless a separate written agreement states otherwise:
- Support is provided on a reasonable-efforts basis.
- No specific response time is guaranteed.
- Compatibility with every hosting environment, theme or third-party plugin is not guaranteed.
- The Agency is not obligated to provide custom development or installation services.
Nothing in this section restricts rights granted under the GPL.
10. Prohibited unlawful use
Users must not use RC Tool to facilitate unlawful transactions or activities.
Merchants are responsible for ensuring that their products, services, advertising and business activities comply with applicable laws.
Where the Agency separately provides a service or payment arrangement, additional eligibility and prohibited-business requirements may apply under the relevant agreement or third-party provider’s rules.
This section does not restrict the rights granted by the GPL to use, modify or redistribute the Software.
11. Disclaimer of warranties
RC Tool is distributed under the applicable GPL licence.
To the maximum extent permitted by law, the Agency does not provide additional warranties unless expressly agreed in writing.
The Agency does not guarantee that the Software will:
- Operate without interruption or errors.
- Be compatible with every WordPress environment.
- Meet every Merchant’s particular business requirements.
- Prevent all security incidents or data loss.
- Remain compatible with every third-party service or future software update.
Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
12. Limitation of liability
To the maximum extent permitted by applicable law, the Agency will not be liable for indirect, incidental, special or consequential losses arising from the use or inability to use RC Tool.
This may include loss of profits, business interruption, loss of customers, loss of data, hosting failures, payment-provider failures or losses resulting from Merchant configuration errors.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded under Nigerian law.
13. Security
Users are responsible for maintaining appropriate security on their own websites.
The Agency recommends:
- Using strong administrator passwords.
- Restricting access to trusted personnel.
- Protecting payment API credentials.
- Maintaining regular backups.
- Updating WordPress and installed software.
- Using secure hosting and HTTPS.
- Investigating suspicious website activity promptly.
The Agency may publish security updates where appropriate.
14. Changes to these Terms
The Agency may update these Terms from time to time.
Each published version will display its own version label and effective date.
Material changes will be identified where reasonably appropriate.
Changes to these Terms do not retrospectively remove rights already granted under an applicable GPL licence.
15. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria.
Any dispute should first be addressed through good-faith communication. Where a dispute cannot be resolved informally, the parties may seek remedies before a court or other forum with appropriate jurisdiction under Nigerian law.
